Editorial responsibility for the site lies with the Management Committee of the Coopérative des Producteurs de Fromages d'Alpage L'Etivaz AOP.

4. Intellectual property rights
All elements on the site (texts, photographs, logos, videos, databases, etc.) are protected by Swiss intellectual property law and remain the exclusive property of the Cooperative or their respective authors.
Any reproduction, representation, modification or use, in whole or in part, is prohibited without prior written authorisation. The name «L'Etivaz PDO» is a protected designation of origin entered in the federal register of PDO-PGI.
5. Limitation of liability
The Cooperative endeavours to keep the information available on the site up to date and accurate. It declines all responsibility in the event of error, omission or temporary unavailability. Links to third-party sites do not incur the Cooperative's liability.
6. Applicable law
The site is governed by Swiss law. Any dispute relating to its use will be submitted to the exclusive jurisdiction of the courts of the canton of Vaud.
Part II - General Terms and Conditions of Sale
Art. 1 - Scope of application
These General Terms and Conditions of Sale (hereinafter referred to as the «GTCS») apply to all orders placed on the online shop. www.etivaz-aop.ch from the Coopérative des Producteurs de Fromages d'Alpage L'Etivaz AOP (hereinafter referred to as «the Coopérative»).
By validating his/her order, the Customer acknowledges that he/she has read the GCS and accepts them unreservedly. The Cooperative reserves the right to modify them at any time; the applicable version is that in force at the time the order is placed.
Art. 2 - Products
The products on offer are alpine cheeses and by-products (rebibes, fondue, râpé, etc.) made to the specifications of the L'Etivaz PDO Protected Designation of Origin.
Photographs and descriptions are provided for information only. Due to the artisanal nature of cheeses, slight variations in weight, colour or taste are inherent to the product and do not constitute a defect. The weight indicated is an average weight; invoicing is based on the weight actually delivered.
Art. 3 - Prices

The Cooperative reserves the right to change its prices at any time. Orders are invoiced at the price in force at the time they are placed.
Art. 4 - Placing an order
To place an order, the Customer must :
- Select the products you want and add them to your basket
- Enter delivery and invoicing information
- Choose your delivery method
- Select payment method
- Check the summary, then confirm by clicking on «Order».»
The sales contract is concluded on receipt of the order confirmation by e-mail. The Cooperative reserves the right to refuse any order for legitimate reasons (seasonal stock shortage, address not served, etc.).
Art. 5 - Product availability
Etivaz PDO is a seasonal cheese, produced only between 10 May and 10 October. Availability may be limited depending on the Cooperative's stocks. In the event of unavailability after confirmation, the Customer may opt for a substitute product, a postponement of delivery or a full refund.
Art. 6 - Payment
Payment is due when the order is placed. The methods of payment accepted are indicated on the Shop. The transaction is secured by an SSL/TLS encryption protocol. If payment is refused, the Cooperative reserves the right to cancel the order.
Art. 7 - Delivery
7.1 Delivery zones
The Boutique delivers to Switzerland and, subject to applicable customs and health formalities, to certain countries in the European Union. The areas served are specified on the delivery information page of the site.
7.2 Delivery times
Indicative delivery times are given when the order is placed. Shipments are made Monday to Wednesday in order to avoid any weekend transit. The Cooperative cannot be held responsible for delays attributable to the carrier or to circumstances beyond its control.
7.3 Packaging and cold chain
Cheeses are dispatched in insulated packaging with appropriate cooling packs. Upon receipt, the Customer must immediately place the products in the refrigerator (4 °C - 8 °C) and observe the storage conditions indicated on the packaging.
7.4 Checking on receipt
On receipt, the Customer must check the condition of the packages. Any anomaly (damaged package, missing product, break in the cold chain) must be reported to the carrier on the delivery slip, and then confirmed in writing to info@etivaz-aop.ch in 24 hours following receipt.
Art. 8 - Right of revocation
Perishable food products are expressly excluded from the legal right of cancellation. However, if the Customer wishes to cancel an order, he/she may contact the Cooperative as soon as possible. 24 hours following order confirmation, before dispatch, to info@etivaz-aop.ch. After this period or after dispatch, no cancellations will be accepted due to the perishability of the products.
Art. 9 - Guarantees and claims
In the event of a defective or non-compliant product, the Customer has a period of 48 hours after receipt to send a reasoned complaint with photographs to info@etivaz-aop.ch. The Cooperative will offer to replace the product, issue a credit note or provide a refund, depending on the nature of the defect (art. 197 et seq. of the Swiss Code of Obligations).
Art. 10 - Transfer of risk
The risks associated with the products (loss, deterioration) are transferred to the Customer when the goods are handed over to the carrier.
Art. 11 - Protection of personal data
11.1 Data controller

11.3 Purposes and legal basis
This data is processed for the purposes of fulfilling the sales contract (art. 31 nLPD / art. 6 al. 1 let. b RGPD for EU residents), managing customer relations and sending commercial communications with the Customer's consent.
11.4 Conservation
Data is kept for as long as is necessary to fulfil the contract and comply with legal obligations (10 years for accounting data, art. 958f of the Swiss Code of Obligations).
11.5 Rights of data subjects
In accordance with the nLPD (in force since 1 September 2023), the Customer has a right of access, rectification, deletion, portability and opposition, to be exercised in writing to info@etivaz-aop.ch.
11.6 Cookies
The site uses the technical cookies required for its operation and, with the user's consent, analytical and marketing cookies. Preferences can be managed via the cookies banner or browser settings.
Art. 12 - Force majeure
The Cooperative may not be held liable for failure to perform its obligations as a result of an event of force majeure within the meaning of Article 119 of the Swiss Code of Obligations (natural disaster, epizootic disease, pandemic, act of God, serious disruption of transport, etc.). The Customer will be informed as soon as possible.

Art. 14 - Applicable law and place of jurisdiction
These GTC are governed by Swiss law. Any dispute shall be submitted, after an attempt at amicable resolution, to the exclusive jurisdiction of the Swiss courts. courts in the canton of Vaud.

Art. 15 - Miscellaneous provisions
If a provision of the GTC is declared null and void, the other provisions will remain valid. The fact that the Cooperative does not take advantage of a breach by the Client does not constitute a waiver of the right to invoke this provision at a later date.
